Who qualifies for a giveaway fraud claim.

The factors below describe the kinds of cases we take on. This isn't a complete list, and meeting every item doesn't guarantee we'll take your case. An attorney makes the final decision based on your specific facts.

Factors we look for.

  • You are 18 years of age or older.
  • You are a U.S. resident.
  • You personally entered the giveaway.
  • You followed the stated entry rules.
  • The promotion occurred within the applicable statute of limitations.
  • You have at least some record or evidence of the promotion.

You won, but the prize never arrived. The promoter stopped responding.

The "random" drawing wasn't random

The announced winner was a friend, relative, employee, or repeat winner — not a random pick.

The entry period closed. The promoter went silent. No winner, no explanation.

The rules changed mid-promotion

Eligibility, entry rules, or the prize were changed after you entered.

What you got wasn't what was promised

The prize arrived, but it was smaller, older, counterfeit, or a cheap substitute.

You had to give up more than you signed up for

Entering required personal info, payment details, or account access that wasn't disclosed.

You don't need all of these to apply. A single clear failure — a prize promised but never delivered, for example — can be enough. This list isn't exhaustive; other patterns may qualify.

What we generally can't help with.

  • Giveaways run outside the United States.
  • Promotions where you received the prize as described.
  • Cases where you didn't enter, or didn't follow the rules.
  • Complaints about a platform's conduct rather than a promoter's.
  • Legal matters outside of deceptive promotions.

Evidence that strengthens your claim.

  • A link to the original post — even if the post was deleted.
  • Screenshots of the rules as posted.
  • DMs with the promoter.
  • Any record that you entered.
  • Receipts or shipping records related to the prize.
If your record is incomplete, submit anyway. We can often reconstruct from platform archives.
05  ·  Final decisions

A note on final decisions.

An attorney reviews every qualifying claim and has final discretion. If we decline, we'll tell you why.
